May 27, 2022 Court Rules Delta 8 Federally Legal A California federal appeals court ruled last week that delta-8 THC and other cannabinoids derived from hemp are legal under the 2018 Farm Bill. The 2018 Farm Bill defined hemp as “the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.” After the 2018 Farm Bill passed, many states passed their own hemp bills. Some of the bills mirrored the language in the federal law, while a few states passed specific laws outlawing the cannabinoid. Our FAQ page includes more information about the States that all delta 8 purchases. Overall, this is excellent news for an industry driven by thousands of dedicated farmers and a cannabinoid customer base that depends on the plant for wellness.
